Even a cursory examination of Saint Vincent’s extant correspondence and the two volumes of select documents in the English translation of Pierre Coste will demonstrate that as superior general of the Congregation of the Mission and the Daughters of Charity, as the ecclesiastical superior of the Paris Monasteries of the Visitation, and as Church reformer Vincent de Paul was constantly attending to legal matters, the details of civil and canon law and the questions of rights, responsibilities, precedents, and litigation.<\/p>\n

It must be remembered that Ancien R\u00e9gime France was governed by multiple local legal codes with their accompanying justice systems. The most important national law codes and justice systems were, of course, royal and canon law. As a Catholic confessional state, Roman Catholic canon law had official status within the Kingdom of France in all the areas of ecclesial jurisdiction. The “code” or body of canon law which under papal authority universally governed Roman Catholicism was supplemented by, and even modified by, the particular ecclesial customs, traditions, and norms unique to each European Catholic kingdom.<\/p>\n

Thus in France, the so-called “Gallican Liberties” encapsulated the ways in which under royal sacral authority the universal canons of the Roman Catholic Church were adapted to the French Church. No act of papal authority, doctrinal or juridical, came into effect in France without royal assent. In this era the papacy, in large part, had reluctantly assented to these national adaptations through a complex system of detailed agreements or “concordats.” These settlements set out the complementarity of the canonical rights and responsibilities of both the roman pontiff and the national churches. Yet, inevitably there were struggles and disputes between the Holy See and successive French monarchs over interpretation, precedents, and the application of particular law versus universal law.<\/p>\n

As a canon lawyer, Vincent’s familiarity with these canons both from the Roman and Gallican perspectives were absolutely essential to the success of his various works and his reform activities.<\/p>\n

The present text is a 1637 volume by the French Jesuit canonist, Etienne Bauny (1564-1649), laying out the Church’s canon law as adapted for the French Church.<\/p>\n
